MYACCIDENT PROTECT – TERMS AND CONDITIONS

 

 

  1. INTRODUCTION

 

MyAccident Protect has been specifically designed to provide you with the following protection when you have experienced a motor vehicle accident on a South African public road:

MyAccident Protect will ensure that you are medically evacuated from the scene of the accident and transported to the closest Private Hospital for admission, treatment and hospitalisation if necessary, subject to the terms and conditions, exceptions and limitations contained within this document.

This document provides all the information you need to know about your MyAccident Protect product.

We ask that you please read through this document and ensure that you familiarise yourself with the terms and conditions, cover provided, as well as your responsibilities.

 

  1. DEFINITIONS

 

MyAccident Protect

MyAccident Protect is administered by Argentum Solutions (Pty) Ltd.

Argentum Solutions (Pty) Ltd. is registered with the National Credit Regulator (NCRCP 15544)

 

The Administrator

Argentum Solutions (Pty) Ltd. (FSP No. 45036) Reg No. 2013/126290/07.

 

BizExtend

BizExtend (Pty) Ltd is an authorised third party to act on our behalf to publish and manage our MyAccident Protect App.

Accident                      

An unfortunate and accidental motor vehicle incident (eg. collision) on a public road within the Republic of South Africa, that happens unexpectedly and unintentionally, resulting in physical injury to the member/s. This excludes any intentional or self-inflicted injury. 

 

Bodily injury

Any injury to the Member’s body caused by an Accident. This excludes sickness or disease. 

 

Medical Expenses

In the context of this MyAccident Protect product, Medical Expenses are defined as:

  1. i) The fee/s associated with medical evacuation of the Member post-Accident to the nearest Private Hospital.
  2. ii) Any fee/s associated with admission into the hospital for medical examination, diagnosis and treatment.

iii) The medical expenses associated with treating the condition/ailment that occurred as a direct result of the Accident.

  1. iv) In the event that the Member is hospitalised for treatment, the hospital account and related costs, as well as the Emergency Room costs are covered.
  2. v) Physiotherapy and Occupational Therapy following hospitalisation as an inpatient as a direct result of the Accident.

Note that all medical expenses as defined above are covered up to the Benefit Limits as detailed in Section C.

 

Benefit Limits

Benefit Limits depicted represent Total Benefit payable per incident.

All Benefit Limits include Vat at the ruling rate. 

 

Physiotherapy

The treatment of disease, injury, or deformity by physical methods such as massage, heat treatment, and exercise rather than by drugs or surgery.

 

Occupational Therapy

Occupational Therapy (OT) involves the use of particular activities to help patients develop, recover and improve the skills needed for daily living and working.

 

Inter-Hospital Transfer

If the Member needs to be transferred to another Medical Facility for medical treatment required as a direct result of the Motor Vehicle Accident, this is covered by MyAccident Protect.

 

MRI and CT Scan Benefit

In the event that the Member is admitted as an inpatient and hospitalised as a result of an injury or injuries suffered due to a Motor Vehicle Accident, MyAccident Protect covers the cost of an MRI or CT scan that is necessitated due to such injuries sustained.

Medical Emergency

An Accident that results in the need for immediate and / or urgent Emergency Medical Transportation. 

 

Emergency Medical Transportation

The transporting of the Member by Emergency Services post-Accident to the nearest Private Hospital.

In the event of a Medical Emergency, MyAccident Protect covers the cost of necessary medical expenses of surface and/or air transportation, medical care during transportation, communications and all usual ancillary charges incurred in moving the Member, when in serious medical condition, to the nearest Private Hospital post-Accident.

 

Repatriation

The expenses necessarily and unavoidably incurred in transporting the member to a hospital where such transportation needs to be completed under medical supervision.  

 

Member/s

MyAccident Protect individual membership or family membership including member’s beneficiary/ies as listed on the Product Schedule.

Individual Standard/Prestige: Member Only, no dependents.

Family Standard/Prestige: Member with up to a maximum of 4 dependents.
Note: If the membership fee is in arrears at the date of the accident, such person/s will not be eligible for the benefits offered by MyAccident Protect. 

 

 

 

Family Membership                                                                                                                         

MyAccident Protect Family Membership applies to the main member, spouses, dependent children and domestic partners.

MyAccident Protect limits the number of dependent children to 4 (four).

Dependent Children

Unmarried children of the MyAccident Protect main member – who are under 21 years of age.

Domestic Partner

A person who is living with the main member in a close personal and/or intimate relationship.

Note: Family Membership Total Limit of Liability per incident is as follows:

Standard Membership: Limited to R200 000 in total.

Prestige Membership: Limited to R500 000 in total.

 

Membership Fee

The membership fee as detailed on the Product Schedule.

In the event of a dispute, the Administrator reserves the right to verify the monthly premium being received, which determines the cover.

 

Product Schedule

The Proposal Form that has been agreed to and signed by the member, whether manually, electronically or via voice recorded telephonic call. These Terms and Conditions form part of the Product Schedule.

 

Agreement

This Terms and Conditions document and the Product Schedule both form part of the MyAccident Protect Terms and Conditions. Together, they represent the Agreement between MyAccident Protect and the Member.

 

Motor Vehicle

SA road-travelling motor vehicles powered by internal combustion-, electric hybrid- or fully electric engines. Includes Automobiles, Light-, Medium- and Heavy Commercial Vehicles, Buses, Taxis. Excludes Motorcycles.

 

Motorcycle

A 2- or 3-wheeled SA road-travelling vehicle that is motor engine – driven, whether internal combustion, electric hybrid or fully electric.

 

Pedestrian

In the context of this MyAccident Protect product, a pedestrian is defined as:

Someone who is travelling on foot, i.e. walking, jogging, running (and not travelling in a vehicle) on-, next to- or adjacent to a public road within the Republic of South Africa.  

 

Travel

Utilising the Motor Vehicle for the purpose of transportation / carriage / conveyance / haulage.

 

Leisure Utilisation

The use of the Motor Vehicle in a different capacity to travelling on SA roads.

 

 

 

Healthcare Professional 

A qualified and registered Medical Practitioner who is a registered member of the Health Professions Council of South Africa (HPCSA).   

 

Nurse

A qualified nurse who is registered with the South African Nursing Council (SANC).

 

Treatment

Medical consultation with or care, therapy, examination or treatment by a Healthcare Professional for the purpose of doctoring, taking care of, healing or observation of the Member’s medical condition as a result of the Accident.

 

Inpatient Hospitalisation

Admission into a Hospital Ward, only as a result of a Motor Vehicle Accident (MVA). Please note: In order to qualify for the Inpatient Hospitalisation Benefit, the Member must be hospitalised within 8 hours of the MVA event.

Hospital

A Healthcare Facility that meets the following criteria:

  1. i) Has the necessary medical facilities (diagnostic, therapeutic and healing) to allow for medical and surgical diagnosis, treatment, care of, therapy, healing and monitoring of the member / patient.
  2. ii) Ensure that all medical activities as defined in i) above are performed by or under the supervision of a staff of Healthcare Professionals as defined within.

iii) Ensure that the medical activities as defined in i) above are supported by or under the supervision of a staff of Nurses as defined within.

  1. iv) Is situated within the geographic territory of the Republic of South Africa.

 

Residence

The area within the territorial boundaries which are used primarily for domestic residential purposes (usual place of residence), within the Republic of South Africa.

 

Service Provider

The selected correspondents and contractors appointed by MyAccident Protect to render the services to the Member.

 

Territory

The Republic of South Africa.

 

 

  1. BENEFITS PROVIDED

 

  1. MEDICAL EMERGENCY BENEFITS

 

The following Medical Emergency Benefits shall be delivered by the Service Provider appointed by the Administrator:

1.1   EMERGENCY MEDICAL RESPONSE AND STABILISATION AT THE SCENE OF A MEDICAL EMERGENCY

24/7 Emergency Medical Response to the scene of an Emergency by appropriate road and/or air response. This includes ambulance or rapid response vehicles and/or helicopter, as applicable (operated by qualified medical personnel and/or paramedics and/or doctors). If applicable, lifesaving support will be provided to the Member, who will be stabilised before transfer is provided to the closest appropriate Medical Facility.

 

     1.2   24/7 EMERGENCY MEDICAL TRANSPORTATION FROM THE SCENE OF THE EMERGENCY

The Medical Service Provider will provide Emergency Medical Transportation by road and/or by air as required), under appropriate medical supervision as applicable, to the nearest Private Medical Facility suitably equipped to provide the required medical treatment. Medical considerations such as the medical urgency of the situation, the distance to be travelled, weather conditions, etc. will influence the nature of the Emergency Evacuation Transportation. The costs of the Emergency Evacuation Transportation will be covered by MyAccident Protect.

 

     1.3   EMERGENCY MEDICAL INFORMATION

Lifesaving medical advice can be accessed where a medically trained professional will be able to guide you through a medical crisis.

 

     1.4   MEDICAL HOTLINE

Medical personnel, including paramedics, nurses and doctors, will be available 24 hours a day to provide general medical information. This is an advisory and information service, as a telephonic conversation does not permit an accurate diagnosis.

 

    1.5    EMERGENCY ROOM (ER) STABILISATION

Guarantee of Payment for emergency stabilization at a medical facility’s Emergency Centre is provided by MyAccident Protect, up to R5 000. This will be recovered from the medical scheme if applicable.

 

 

  1. HOSPITAL ADMISSION BENEFIT

In the event that the Hospital charges an Admission Fee before admitting the Member, MyAccident Protect will pay for this, up to the Benefit Limit.

  Prestige Option Benefit Limit: R5000.

  Standard Option Benefit Limit: R2500.

 

 

  1. EMERGENCY ROOM (ER) OUTPATIENT BENEFIT

The ER Outpatient Benefit covers the cost of medical treatment on an Outpatient basis in an Emergency Room, Casualty Ward or Hospital Emergency Unit, provided that the medical treatment is required for the member who has been in an Accident on a South Africa Public Road.

Prestige Option Benefit Limit: R5000.

Standard Option Benefit Limit: R2500.

 

  1. MRI AND CT SCAN BENEFIT

In the event that the Member is admitted as an inpatient and hospitalised as a result of an injury or injuries suffered due to a Motor Vehicle Accident, MyAccident Protect covers the cost of an MRI or CT scan that is necessitated due to such injuries sustained. This benefit forms part of the Hospitalisation Inpatient Benefit, and is only payable if Pre-authorisation is requested and approved.

 

 

  1. PHYSIOTHERAPY AND OCCUPATIONAL THERAPY BENEFIT

The Physiotherapy and Occupational Therapy Benefit applies following the Member being hospitalised on an Inpatient basis as a result of an Accident on a South African Public Road.

This Benefit is only applicable for 3 (three) months following discharge of the Member from Hospital. The Benefit Limit of R3000 applies to Prestige Members only and requires pre-authorisation.

 

  1. HOSPITALISATON INPATIENT BENEFIT

MyAccident Protect covers the cost of all medical expenses associated with Inpatient Hospital Medical Treatment, provided that such Inpatient Treatment is required as the direct result of a Motor Vehicle Accident on a South African Public Road.

Note that an Inpatient is defined as a patient who is admitted into a Hospital Ward, only as a result of a Motor Vehicle Accident (MVA). In order to qualify for the Inpatient Hospitalisation Benefit, the Member must be hospitalised within 8 hours of the MVA event.

Note that this benefit requires pre-authorisation.

Standard Members: Benefit Limit of R200 000

Prestige Members:  Benefit Limit of R500 000 

Note that Inpatient Hospital Medical Treatment includes the following:

  • Surgery required as a direct result of the Motor Vehicle Accident
  • Rehabilitation services for severe injuries sustained as a direct result of the Motor Vehicle Accident

Please Note: The Administrator reserves the right to appoint an alternate medical practitioner to verify accuracy of diagnosis and to ensure that appropriate medical treatment is being provided.

 

 

  1. INTER-HOSPITAL TRANSFER

If the Member needs to be transferred to another Medical Facility for medical treatment required as a direct result of the Motor Vehicle Accident, this is covered by MyAccident Protect. Inter-Hospital Transfer will be carried out by appropriate road and/or air response. This includes ambulance or rapid response vehicles and/or helicopter, as applicable (operated by qualified medical personnel and/or paramedics and/or doctors). This benefit forms part of the Hospitalisation Inpatient Benefit, and is only payable if Pre-authorisation is requested and approved.

 

 

  1. UNLIMITED TELEPHONIC LEGAL ADVICE

Free unlimited telephonic Legal Advice is provided to Members who were in a Motor Vehicle Accident on a South African Public Road.

 

 

  1. COMPASSIONATE VISITS

Should a member be admitted to hospital for a period exceeding 5 consecutive days, outside their home town where the hospital has a greater distance than 180km from their usual residence, arrangements will be made to transport a close relative to visit the member, up to the limit of

R2 000 per admission.

 

 

 

  1. ESCORTED RETURN OF MINORS

In the event of minor children being stranded as a result of a member’s hospitalization, MyAccident Protect will provide transportation, under supervision where necessary, into the care of a person nominated by the member, within the Territory

 

 

  1. TREATMENT POST-MVA (MOTOR VEHICLE ACCIDENT)

In the event that the Member is not transported to a Medical Facility because his/her medical condition is not deemed to be serious enough – but such Member would like to see a doctor thereafter for minor injury or pain as a direct result of the MVA event: MyAccident Protect provides an allowance of 24 hours after such MVA event for such treatment.

Please Note:

  • Pre-Authorisation is required
  • A Police MVA Report must be submitted to MyAccident Protect within 48 hours after such treatment.    

Prestige Option Benefit Limit:   R2000.

  Standard Option Benefit Limit: R1000.

 

Note the following with regard to Section C:

  • The Administrator may require pre-authorisation to access benefits regarding any Service Provider at any time for a Member, in order to ensure the best possible patient management and care.
  • The Administrator will submit a claim to the Road Accident Fund (RAF) relating to the Member’s MVA incident. The proceeds provided to the Member are ceded to MyAccident Protect, up to the Credit Amount paid by MyAccident Protect for the Member’s treatment.  
  • If the Member is assigned Observation status, note that he/she is viewed by the Administrator as an Outpatient while within such status. 

 

 

 

  1. PANIC BUTTON – APPLICATION AND PROCESS
  • Once the client purchases the product and becomes an active Member, he/she receives a sms and/or e-mail with the details of a Panic Button Application, which is to be downloaded from either Apple App Store or Android Play Store.
  • Once downloaded, the Member is requested to register on the landing page.
  • The Panic Button will then be visible as an icon on the Member’s phone.
  • When in need, the Member is to press on the icon and hold the trigger button for 3 seconds to raise a panic alarm.
  • The Member will receive an on-screen message to advise that a request for assistance has been raised, and that a case manager will be making contact shortly.
  • The 24/7 Contact Centre will receive the panic alarm and call the member to establish the exact nature of the emergency.
  • Depending on the assessment, an ambulance may be dispatched, or alternatively, guidance will be provided in respect of a claim.
  • Should the Location Based Services be active on your phone and your network allows it, the details of your location will also be sent to the 24/7 Contact Centre.
  • [Please Note: Neither the Administrator nor the Contact Centre will accept any liability should the panic not have been sent successfully due to network issues due to technical reasons such as loadshedding, over subscription, etc.]
  1. PROVISIONS AND LIMITATIONS

 

  1. The benefits and services of MyAccident Protect as summarised above in Section C, are provided on the following basis:
  1. i) Membership of MyAccident Protect is active at the time of Accident. [Ie: The Membership Fee has been paid and is up to date and has been received by MyAccident Protect.]
  2. ii) MyAccident Protect cover has commenced.

iii) The Benefit Limits are only payable if the Accident occurs within the geographical territory of the Republic of South Africa.

  1. iv) Subject to a successful claim, MyAccident Protect will provide funds to the member for specific Medical Expenses as defined within, up to the limits as detailed in Section C above, arising as a direct result of an Accident.

These funds will be provided on a pay up front, claim back basis.

 

These “Pay-Up Front, Claim Back” Medical Expenses are:

  • Emergency Medical Evacuation Transportation
  • ER Outpatient Benefit
  • Physiotherapy and Occupational Therapy Benefit Post Hospitalisation Discharge (Prestige Members Only)
  • Treatment Post-MVA

(In the event of the Member being unconscious and/or hospitalised, the benefits are provided on a Credit basis.)

 

Note: Providing benefits on a Credit Basis means that the Administrator provides the Hospital with a Guarantee that the funds will be paid. This MyAccident Protect Guarantee is accepted by Private Hospitals

 

 

  1. Not Covered

Any expenses not defined in Section C within this document.

   

  1. The benefits provided by MyAccident Protect are provided to:
  1. A Member who has sustained an injury or injuries suffered while driving or a motor vehicle or as a passenger in a motor vehicle on a public road in South Africa.
  2. A Member who has sustained an injury or injuries while travelling as a fare-paying passenger of a public transportation vehicle that experienced an Accident on a public road in South Africa. [This includes buses and taxis].
  • A Member who, as a pedestrian, has sustained an injury or injuries caused by a motor vehicle accident – while travelling on foot, i.e. walking, jogging, running on-, next to-, or adjacent to a public road within the Republic of South Africa.

Note: If such Member who, as a pedestrian has sustained such injury/injuries while attempting to cross a Public Road in a location not specifically designated as a Pedestrian Crossing, such Member will not receive any benefits of the MyAccident Protect product. The Administrator reserves the right to request applicable documents, eg. Police MVA Report.

 

  1. If, for whatsoever reason, the Member is medically evacuated to a Government/State Hospital instead of a Private Hospital, MyAccident Protect cannot be held responsible and accountable for such. 

In such an event, and upon being informed thereof, MyAccident Protect shall have the Member transferred to a private hospital, provided that the doctors under whose care the Member is, allow for such transfer.

 

 

 

  1. Cession 

By signing and therefore agreeing to these Terms and Condition, the Member cedes to MyAccident Protect the proceeds* of any claim on behalf of the Member, including whether the claim is against another person who may be liable to compensate the Member, or whether the claim is against the Road Accident Fund.

MyAccident Protect reserves the right to appoint its preferred attorney to manage the claim, or to change the attorney if it so chooses.

* Note:

  1. i) In the event of Credit having been provided to the Member: The Credit provided to the Member is immediately repayable by the Member to MyAccident Protect once the Member has received payment for the Road Accident Fund (RAF) claim or from the liable party, as applicable.
  2. ii) Should a member hold medical cover through any other type of membership, insurance policy, medical scheme, benefit programme, service provider, RAF, then MyAccident Protect reserves the right to recover all costs incurred pertaining to the Services from such other policy, medical scheme, service provider, compensation, fund or benefit.

iii) The Member will be reimbursed any money received by MyAccident Protect in excess of the Credit provided to the Member.

 

 

  1. CONDITIONS AND STIPULATIONS

 

  1. PROVISION OF CREDIT/REIMBURSEMENT OF FUNDS
  1. Credit is provided in the event of the Member being unconscious and/or hospitalisation only.

Note: Providing benefits on a Credit Basis means that the Administrator provides the Hospital with a Guarantee that the funds will be paid. This MyAccident Protect Guarantee is accepted by Private Hospitals

  1. If the Member requires treatment as a result of an Accident, it is the Member’s responsibility to present a written request for reimbursement within 48 hours of such treatment, but not later than 1 month from such treatment, if the cause of delay in request submission is outside of the control of the Member or his/her dependant/s.
  • It is the Member’s responsibility to provide – as soon as possible after the Accident – any and all information and/or proof requested by MyAccident Protect that will put MyAccident Protect in a position to recover the funds provided from the person liable, if applicable.
  1. If requested by MyAccident Protect, the Member is to provide the authority to MyAccident Protect to access blood tests and any and all medical records and information upon request.
  2. The member must agree to any and all Medical Examinations requested by MyAccident Protect. The provision of Credit/Reimbursement is conditional on the Member subjecting himself/herself to such requested Medical Examination/s. MyAccident Protect is liable for the cost of such requested Medical Examinations.
  3. Any Credit that is due for Hospitalisation will only be payable at the termination of the period of such Hospitalisation.
  • Any Credit/Reimbursement payable will be paid directly to the Member or alternatively, on behalf of the Member to his/her legal representative. Receipt thereof represents the completion of MyAccident Protect’s responsibility for such payment.
  • Interest or charges of whatsoever nature do not apply to Credit awarded.
  1. Any Credit/Reimbursement that is necessitated as per these Terms and Conditions which is outstanding after a period of 1 (one) year from the date of Accident, will have lapsed and be deemed null and void, unless such is the subject of pending legal action.
  2. Should a member hold medical cover through any other type of membership, insurance policy, medical scheme, benefit programme, service provider, RAF, then MyAccident Protect reserves the right to recover all costs incurred pertaining to the Services from such other policy, medical scheme, service provider, compensation, fund or benefit.

 

  1. MEMBERSHIP
  1. The Membership Fee is payable monthly in advance. Membership will be regarded as cancelled if the Membership Fee is not received on the Debit Order Due Date. MyAccident Protect will therefore not be liable for any Credit provision relating to any Accident that occurs after such due date where payment was not received.
  2. The Membership Debit Order Due Date is the Member’s chosen Debit Order date as reflected on the Product Schedule.
  • Regardless of whether a Member commences or terminates Membership during the course of a month, a full month’s Membership Fee is payable.

 

*The Administrator reserves the right to implement an annual increase of 10% to the monthly membership. Such will occur on the annual purchase date of your Membership.

   

  1. START DATE

The benefits of MyAccident Protect start 30 days after the date of the first successful Debit Order collection.

 

 

  1. TERMINATION

MyAccident Protect may terminate this Agreement by providing the Member with 30 (Thirty) days’ notice thereof in writing.

 

 

  1. CANCELLATION

The Member may cancel this Agreement by providing MyAccident Protect with 30 (Thirty) days’ notice thereof in writing.

 

  1. ADJUSTMENTS

MyAccident Protect reserves the right to adjust or revise the Membership Agreement Terms and Conditions, Benefits and/or Product Schedule by providing the Member with 30 (Thirty) days’ notice thereof in writing.

 

  1. JURISDICTION

The MyAccident Protect Terms and Conditions are subject to the laws of the Republic of South Africa, whose courts have sole and exclusive jurisdiction.

 

 

  1. TERRITORY

The benefits of MyAccident Protect are only applicable to active Members who experience Accidents on public roads within the geographic territory of the Republic of South Africa.  

 

  1. CURRENCY

Any payment/s made to MyAccident Protect must be in the currency of the Republic of South Africa, unless otherwise agreed.

 

 

 

  1. EXCLUSIONS

 

The Member will not qualify for any of the benefits of MyAccident Protect in the following circumstances:

  1. Should a member obtain Services without MyAccident Protect’s authorization or intervention, MyAccident Protect’s liability, if any, will be limited to the applicable negotiated tariff.
  2. Expenses arising from wilfully inflicted self-injury or illness, insanity, alcoholism, drug or substance abuse and/or the Member commits suicide or attempts to commit suicide or intentionally cause harm to himself.
  3. Self-exposure to needless peril (except in an attempt to save human life);
  4. Any sports undertaken on a professional basis or on a national or provincial competitive basis unless the Member has obtained prior written approval from MyAccident Protect;
  5. The commission of or the attempt to commit an illegal act and/or the Member has contravened the law in any way in the circumstances relating to the accident.
  6. The Member’s active participation in war (whether declared or not), invasion, act of foreign enemy hostilities, rebellion, riot, revolution or insurrection nor for any consequence or loss which is a direct result of nuclear reaction or radiation;
  7. The Member takes part in Police/Reservist duty, Military duty, Security duty, Civil Commotion or Disturbances of any nature, including, but not limited to, riots and strike action;
  8. Consequential loss of any kind;
  9. Events which occur before the entry into force of this Agreement and / or after the lapse or termination of this Agreement;
  10. The Member is found to have any trace of alcohol in his/her blood at the time of the Accident. [Note: MyAccident Protect accepts the validity of Alcohol Test Results produced by a Breathalyzer Device.
  11. The Member utilises the Motor vehicle in the following capacity:
  12. Any form of Racing, Speed Testing, Sport, Recreational activity, driver negligence or abuse.
  13. The Member is the rider or passenger of a Motorcycle when the Accident happens.
  14. The Member uses the Motor Vehicle in a Security or Armed Response capacity.

 

 

 

 

 

 

 

 

 

  1. PERSONAL AND CONFIDENTIAL INFORMATION

 

We will monitor and record all phone calls and other interactions with you. We will keep your personal information only if we need to or must by law and the purpose for which we record your personal and confidential information is set out in this clause. 

  1. In this agreement, personal information means: 
    1.1 information you give us or that we already hold about you include any phone number from which you call us, which we may record; 
    1.2 information about any account or policy which you hold with or through us; and 
    1.3 information we receive from anyone who is allowed to give us information about you pursuant to or in relation to your application or agreement. 
  2. You agree and consent that we may process, record or disclose your personal information, including details of your Agreement, including redeeming of the benefits: 
    2.1 to verify information provided by you against other legitimate sources or databases; 
    2.2 to manage your agreement, and make decisions on questions about any application, agreement or correspondence which you may have with us; 
    2.3 to carry out, monitor and analyse our business; 
    2.4 to contact you by post, by phone, by e-mail, by sms or other electronic means or in any other way about other products and services which we consider may interest you, unless you tell us that you would prefer not to receive such offers; 
    2.5 to comply with any laws or regulations 
    2.6 for the purposes of disclosure of private underwriting and benefit redemption information. 
  3. You agree and consent that we may disclose your personal information to: 
    3.1 any person working for us; 
    3.2 any organisation which underwrites or supports any of our products which you hold; 
    3.3 any guarantor (eg: bank) of your obligations under this Agreement; 
    3.4 any payment system under or through which your Agreement is paid; 
    3.5 any person to whom we transfer any of our rights or obligation under this Agreement; 
    3.6 any businesses or company including any direct marketing companies or businesses with whom we interact to supply to you, or provide to you or market to you any product or service that we believe you may be interested in; 
    3.7 any third-party debt collection agency or attorney appointed to collect any monies you owe us; and 
    3.8 anyone you authorise us to give personal information to; 
    to the lawful extent that we may transfer, license or otherwise authorise the use of any of your personal data and information. 

 

  1. EVENTS BEYOND OUR CONTROL AND INDEMNITY 

 

You waive any rights including taking legal action for any loss, damage, cost or expenses and liabilities which you or a third party may suffer or may have against us relating to: 
1. Anything outside of our reasonable control (for example, a failure of computer systems, or power failures which happen for reasons outside our reasonable control) or any industrial action, or political unrest, war, if this prevents us from providing our usual service; 
2. Any service provided by approved dealers/suppliers; 
3. The provision of information by or to us in terms of this Agreement, except to the extent that we acted with gross negligence or fraudulent intent.

  1. RIGHTS

 

  1. Nothing contained herein shall give any rights against us to any person other than the owner of this Agreement as detailed on the Application. 
  2. You have the right to resolve a complaint by way of alternative dispute resolution.
  3. We and any supplier we use may cede, assign or transfer any of our rights or obligations under this Agreement or arrange for any other person to carry out any of our rights or obligations under this Agreement without your consent and without notice to you.

 

  1. TAXES 

 

All fees payable are inclusive of all taxes at the current ruling rate.

 

 

  1. WAIVER 

If for any reason or purpose we do not immediately enforce or implement any of our rights in terms of the Agreement, it does not mean that we have given up or waived any of those rights. If we cannot enforce any term or condition under the Agreement, it will not affect any of the other terms or conditions in this Agreement except when the whole Agreement is void, which will result in restitution.

The authorised dealer, representative or 3rd party supplier dealing with you must at the earliest reasonable opportunity disclose information to you as required by law which includes the disclosure of commission or fees they earn in relation to this product.

• Complete all forms in ink. 
• Keep all documents handed to you. 
• Make notes as to what is said to you. 
• Don’t be pressurised to buy the product. 
• Incorrect or non-disclosure by you may impact redemption of benefits of your agreement or result in cancellation of the agreement.

If you need advice on any aspect of your agreement, procedure to redeem benefits or your responsibility to pay fees, please call 082 440 7670 with the query. Email queries will be responded to within 2 business days. If the query is urgent, please contact the Administrator telephonically or via email. 
Please note that the Administrator’s operating hours are Monday to Thursday from 08h00 to 16h30 and Fridays from 08h00 to 16h00, (excluding Public holidays and weekends).
